Managing Legal Risk In Your Medical Career

When you get into a medical career, it’s important to understand the awesome responsibility on your hands. You can literally be responsible for the life, death, and well-being of the patients under your care. Not only does this mean that you have to take your role very seriously, but it also comes with some significant legal liability that you have to consider, as well. To that end, we’re going to look at how you should start managing that legal risk to keep yourself protected.

Stay up to date on the law and best practices

First of all, a doctor should always do their best to keep up with the industry. Not only in terms of the latest treatments and breakthroughs in patient care, but changes to the laws, regulations, and best practices that affect their work, as well. There are plenty of medical law blogs that cover changes in relevant laws and regulations that can help you ensure that you’re aware of legal risks in your career. Of course, you should be certain to adhere to clinical guidelines and to take part in what risk management programs you can to mitigate legal risks where they pop up. Negligence is where a lot of legal problems for doctors can begin.

Protect yourself against the threat of malpractice

The biggest threat to any medical career is malpractice. Not every malpractice case is going to end your career, but you should still do everything you can to mitigate the impact. Putting an emphasis on obtaining informed consent for every treatment you provide is vital, ensuring that patients have a complete understanding (where possible) of any risks and alternatives available. Otherwise, make sure that you’re not unprotected from claims. Secure adequate medical malpractice insurance. This covers not only your legal costs but also potential settlements. Even claims that you are found innocent of can be costly, and if the legal repercussions aren’t serious enough to end your career, the financial impact of them can certainly put it on the brink.

Keep meticulous records of everything that you do

Even when you have done nothing wrong, a patient who is disgruntled or has real reason to suspect that they have not been handled with the care they deserve can be a serious threat to your career. To that end, you should make sure that you maintain detailed records of every patient interaction that you have. Of course, there are electronic health records that will keep a note of any treatments provided, but you should be sure to keep your own evidence that you might have to provide if you find yourself under additional legal scrutiny, for your own protection.

The legal risk that comes with being a doctor is not often enough to put one off the path of that career. However, it can certainly be enough to derail the career once you have started. Keep the tips above in mind and invest the time and money into the protections that can keep you safe.
